This will be a true roundtable discussion for in-house counsel: lectern-free with the unique opportunity to share insights and benchmark with your in-house colleagues.  We will discuss maintaining confidentiality and attorney-client privilege when conducting investigations and audits. Topics will include the organization as your client and determining who is and who is not your client; avoiding the inadvertent production of privileged information; and tactics employers can use to make investigations and audits as confidential as possible in today’s changing legal environment.  The discussion will also include the NLRB’s contention that instructing employees not to discuss an investigation can be an unfair labor practice, as well as best practices for auditing employees’ exempt classifications in light of the proposed revisions to the FLSA’s overtime regulations for the white collar exemption.
