Conducting Lawful Investigations: Avoiding the Landmines

Litigation arising out of incidents of harassment, discrimination and other types of workplace events costs organizations billions of dollars each year. Employee lawsuits increasingly focus on the quality of the organization’s investigations and investigators. Often these lawsuits are won or lost based on the jury’s answer to questions such as "Was the investigator properly trained?" or "Could the investigation have been done better?"

At the same time, courts are giving greater deference to properly conducted investigations. Effective, unbiased investigation is one of the best weapons against liability in employment litigation.

This program will involve interactively working through a hypothetical instance of workplace misconduct and the ensuing investigation. The goal of the program is to provide and enhance the skills and experiences necessary to conduct effective internal investigations while identifying the areas where employers most often make mistakes. Using a unique methodology, participants take on the role of an employment relations specialist in a fictional company and work through an actual case taken from litigation files.
