Employers have been pursuing a safe return to work in the best way they know how since the COVID-19 pandemic began. This has required constant diligence, and more than a full-time job, to keep up with ever-evolving guidance from federal, state and local authorities, while also keeping a constant eye on various human resources and employee relations issues. Perhaps nothing has mobilized opinions on, and responses to, these challenges like the increasing availability of the COVID-19 vaccine.

In this virtual program, we will explore some of the most common workplace challenges associated with the vaccine, associated safety protocols (including, but not limited to, face coverings), and related labor and employment law issues. We will discuss the tension between mandatory vaccine policies and those who may be unable to be vaccinated for legally-protected reasons, potential shifts in workplace safety protocols as the CDC, OSHA, and other agencies speak out about how fully vaccinated and unvaccinated individuals can engage in the workplace, the challenges of navigating the ADA’s reasonable accommodation obligations during the pandemic with regard to vaccines, return to work and more, and some of the myths and misinformation circulating about an employer’s rights in each of these areas.
