Human resource professionals confront a constantly changing legal landscape. A single court decision interpreting the WLAD or an NLRB complaint challenging an employer’s social media policy can require the re-evaluation of a previously accepted HR policy or procedure. The aging of America’s workforce, the rising occurrence of workplace bullying and the increasing use of social media all require new approaches to human resource management. In this fast-paced, highly interactive session, we will engage in a lively discussion, using realistic scenarios presented by video and live “actors” to address these 10 critical employment law issues affecting HR professionals now.

  1. How social media can be used in recruiting and how to discipline employees who post employer criticisms
  2. How to identify independent contractor issues and avoid liability under both state and federal law
  3. Reasonable accommodations: The need for process in the interactive process
  4. The difficulties administering leave of absence policies in light of the FMLA and the WLAD
  5. How multi-state employers can consistently enforce HR policies with the variances in state law
  6. How to address the aging workforce—should you welcome older workers, try to keep them from retiring, attempt to recruit younger employees or do all of the above?
  7. How to handle the new pressure on pay equity
  8. How to effectively discipline employees for disparaging and disrespectful behavior when the EEOC and the courts say that you must and the NLRB says that you must not
  9. Should you reconsider using arbitration agreements to avoid class action liability?
  10. Emerging issues, including Seattle Paid Sick Leave Ordinance, weight “discrimination,” bullying concerns, and their impact on the workplace.
