Advanced ADA: The Interactive Process and “Hidden” Disabilities

Employee accommodation requests – and related litigation – are on the rise. While requests often focus on addressing a worker’s physical restrictions under the ADA, dealing with employees’ “invisible” disabilities (such as ADHD and anxiety disorders) can pose more difficult challenges. Using a case study method that encourages participation from the audience, this session will provide employers with practical guidance on handling the accommodation of “hidden” impairments.

Issues covered will include:

  • When employers should move from a concern with an employee’s performance or misconduct to a concern for his/her mental health
  • Customizing ADA paperwork for mental impairment situations
  • Addressing demands for specific accommodations
  • Dealing with vague input from an employee’s medical provider and disconnections between an employee’s statements and input from a provider
  • When – and how – to seek a second medical opinion
