The EEOC published its final regulations related to the Americans with Disabilities Act Amendments Act (ADAAA) on March 25, 2011.

As you may know, on January 1, 2009, the ADAAA became effective, amending the ADA and greatly expanding the definition of "disability," potentially granting a new "disability" status to many more employees. For the last two years we have been operating without regulations interpreting the statute. These final regulations will provide employers the EEOC's guidance on the ADAAA and redefine and mandate how employers treat employees with disabilities.

The new regulations interpret the term "disability" in ways that employers have never envisioned. Employers will be strapped with attempting to accommodate health issues that were never considered disabilities under the previous interpretations of the ADA.
