Increasingly we are seeing federal agencies make efforts to regulate the use of artificial intelligence (AI) in employment decision-making – from recruiting, to hiring, to promotion, and beyond. The Equal Employment Opportunity Commission (EEOC) has already issued a series of “technical assistance" documents outlining best practices and potential concerns with AI in the workplace, the Office of Federal Contract Compliance Programs (OFCCP) has indicated it will be closely scrutinizing the use of AI in employment decision-making by federal contractors, and other federal agencies are following suit. At the same time, the White House has rolled out its Blueprint for a Bill of AI Rights, and lawmakers in Congress are taking up the mantle to explore new laws to govern the use of AI in employment.

In this segment, we will explore administrative and legislative efforts on the federal level to date, offer some predictions as to where these efforts may end up, and provide practical tips on how to prepare for (or preempt) future compliance and regulatory concerns.
