The US Department of Labor (DOL) issued additional guidance on standards and application of the extended paid sick and FMLA leave under the recent Families First Coronavirus Response Act (FFCRA). Some members of Congress are now challenging the DOL’s authority to give such guidance, including the broadening of the definition of “health care providers” that can be excluded from providing paid sick leave and/or expanded family and medical leave under the FFCRA.

Likewise, the latest round of COVID-19 stimulus bills, Coronavirus Aid, Relief and Economic Security Act (CARES), is now law. The CARES Act creates both opportunities and challenges for home care providers. Chief among these challenges is broader access to unemployment benefits that are often higher than the actual wages of many employees. These changes, coupled with the state and municipal shelter in place laws with varying “essential services” definitions and an anticipated fourth stimulus package with a focus on healthcare industry workers, has left many providers with more questions than answers.

Littler has partnered with The National Association for Home Care & Hospice (NAHC) and the Home Care Association of America (HCAOA) to provide a weekly webinar series to assist home health and home care providers to navigate through the complex and seemingly ever changing legal landscape brought about by the COVID-19 pandemic.
