The Challenges of Collecting Data Outside the U.S.

This article discusses collecting data from foreign countries for discovery purposes. Littler attorney Paul Weiner comments on the issue, stating “In the other countries, it’s more of an older school philosophy where you try your case based on the information that you have, and you deal with the information when you get to court. Whereas the U.S. has taken a [contrary] philosophical approach where you get very broad discovery that allows you to know all of the facts before you get to trial.”
