Increased Enforcement and the Continued Class Action Threat Increase the Risks of Noncompliance
The current political climate, coupled with the decline in the economy and mass layoffs, has made the playing field ripe for wage and hour litigation. Reinforced by initiatives of the Obama Administration, the U.S. Department of Labor (DOL) and State Departments of Labor have made clear that investigating potential wage and hour violations is a top priority. Newly announced initiatives from the DOL also attempt to place additional compliance burdens on employers.
Recent case law and pronouncements from the DOL have changed the landscape of overtime exemption for many positions. Additionally, heightened enforcement and penalties regarding Independent Contractor misclassification mandate that employers reevaluate the status of many workers.
This interactive and informative session will discuss current enforcement practices, as well as trends in class and collective actions. Participants will receive detailed recommendations for preventative measures they can take now to reduce the risk of future wage and hour agency actions and class litigation.
