New overtime regulations from the U.S. Department of Labor went into effect last August, and the longer employers wait to review them, the greater the potential financial damages. Employees may sue employers for misclassifying them as exempt from overtime, leading to back wage settlements or employers may be hit with government fines. Littler attorney Joe Harkins advises employers to take action quickly, "Most employers are looking at jobs now and auditing their positions...it's important to do this and make adjustments where required."
