Greg Keating Navigates Definitions of Retaliation

"Payback Time: Thinking of Striking Back at an Employee? Think Twice," Entrepreneur Magazine

In this article which discusses the U.S. Supreme Court's June 2006 decision that expanded the definition of workplace retaliation, Littler's Greg Keating offers insight to employers. "The law in that area is all over the place, from state to state and the federal courts," says Keating. He also notes that "The Supreme Court has basically said [retaliation is] any type of adverse action. It doesn't have to be employment [related]. It doesn't have to be 'I changed your job, cut your pay, moved your office or changed your repsonsibilities.' It can be anything." Keating also predicts corporate legal expenses will climb as more cases reach juries.
