Misty Leslie has counseled and defended public and private sector entities for more than 20 years as both in-house and outside counsel. As a litigation attorney, Misty regularly defends companies against a broad spectrum of employment related claims. Misty also regularly counsels employers on personnel and compliance issues, and her range of experience allows her to provide holistic counsel to minimize and mitigate risk. 

Misty’s experience includes:

  • Investigating and defending discrimination claims involving race, ethnicity, religion, sex, disability, and age (Title VII of the Civil Rights Act of 1964, ADA, ADEA)
  • Defending claims of interference with leave rights and retaliation under the Family and Medical Leave Act, and similar state laws
  • Defending claims of breach of contract, and employment related tort claims, including wrongful termination, constructive discharge, and defamation
  • Investigating and defending whistleblower claims under federal and state statutes, including occupational safety, Sarbanes-Oxley Act, Consumer Financial Protection Act, and similar statues
  • Enforcement of noncompetition agreements, and employer rights related to unfair competition and trade secret violations
  • Wage and hour compliance, including defending claims involving unpaid wages, unpaid overtime, employee/independent contractor disputes, and equal pay
  • Negotiating and drafting noncompete agreements, employment agreements, and separation and release agreements
  • Developing and implementing reductions in force plans
  • Creating policies and procedures related to effectively handling internal discrimination and whistleblower complaints; EEO compliance; leave, accommodations, and work-from-home/remote working; and employee handbooks
  • Training supervisory and line level employees in a variety of areas including effective performance management, leadership, internal investigations, diversity and EEO compliance
