James M. Gilbert is a member of the Littler CaseSmart – Class Action™ team and is based in Illinois. As a brief writer, James formulates and executes briefing strategy for cases. He evaluates and selects legal authority that supports the facts and circumstances of each case and prepares substantive briefs regarding motions for class certification, motions for dismissal or summary judgment, motions to compel arbitration, and motions to remand actions from federal court.

Previously, James spent a number of years as a sole practitioner representing employers in defense of a variety of employment litigation claims, including class and PAGA actions, from inception through appeal, as well as advising clients on employee policy and personnel matters. He has also assisted several other firms with their litigation of class action and PAGA matters. James began his legal career at a small boutique firm in Southern California that specialized in employment law. In total, he has experience working on more than 150 class and representative actions
