Travel with us back to April 2020. The COVID-19 pandemic forced the vast majority of Americans to shelter in place. In some sectors – particularly the hospitality industry – business practically came to a halt. Naturally, workers lost their jobs.

About this same time, several California cities and counties began to actively adopt new ordinances relating to the impact that COVID had on the workplace. One such new law provided a “right to recall" for laid-off workers. These ordinances eliminated a business' discretion to decide which employees to recall from a layoff, or whether to recall any prior workers at all. Instead, they gave workers the right to be recalled in order of seniority. Long Beach, Los Angeles, and San Francisco led the way, but eventually the trend was picked up by several other cities in the Golden State.

Now, one year later, we have a new law that applies across all of California – Senate Bill 93. SB 93 imposes similar recall obligations on a broad swath of hospitality businesses in California. The new law went into effect immediately and includes strict penalties for noncompliance.

Other cities outside of California also have adopted such laws, including Baltimore, Minneapolis, and Philadelphia.

In this webinar, attorneys from Littler's Workplace Policy Institute will describe these new obligations in California and across the country. Practical suggestions for compliance will be offered. We also hope for a robust question and answer interchange with our attendees.
