Prescriptive Period for Labor Cases

The National Labor Relations Commission (NLRC) (sitting en banc) recently clarified that, within the context of disputes undergoing mandatory conciliation-mediation, the prescriptive period for filing a complaint for compulsory arbitration shall be interrupted upon the filing of a Request for Assistance under SENA and shall resume upon receipt by the requesting party of the referral issued by the SENA Desk Officer. (SENA stands for the Single Entry Approach Desk of the Department of Labor and Employment).
