Many employers use independent contractors, temporary staffing, and leased employees to supplement or replace their regular workforce. The legal distinction between employees and independent contractors depends on a number of factors, including the extent to which the employer dictates the terms and conditions of the job. Moreover, joint employer liability also depends on the amount of control the employer has over different aspects of the relationship.

First, this program will examine the latest developments on these topics. The panelists will discuss the recently argued and soon to be released decision in Ayala v. Antelope Valley Newspapers, Inc. (AVP), where the Supreme Court will address whether a case brought on behalf of a putative class of newspaper home delivery carriers alleging they were misclassified as independent contractors rather than employees is amenable to class treatment. Second, the program will examine the critical factors in making the joint employer liability determination, and examine recent developments on this issue.
