On April 5, 2011, the Wage and Hour Division of the U.S. Department of Labor published its final amendments to regulations interpreting the Fair Labor Standards Act of 1938 (FLSA) and the Portal-to-Portal Act of 1947 and the final amendments are effective on May 5, 2011.

The final amendments contain significant changes to tip credit regulations that require employers relying on these regulations and the pay methods set forth therein to take immediate action. Similarly, employers who implement fluctuating workweek compensation programs will find that the final amendments may require immediate changes to their compensation programs.
