A new NLRB rule mandates that private sector employers subject to the National Labor Relations Act post a notice to employees explaining their rights to organize under the law. This new NLRB regulation becomes effective November 14. Because the posting must be in a "conspicuous place" readily seen by employees, for the first time, most employees in the U.S. will now be formally informed of their right to unionize.

The posting requirements are detailed in both form and substance. There are over a dozen employee rights that must be stated in the poster, including the right to strike and picket. Even the size and typeface are regulated! And the form must be posted electronically or with a link to the NLRB's website.

Since many employees will be receiving this notice for the first time, it's natural for them to ask questions like "is the company now supporting us unionizing?" or "you told us we can't talk about our salary with co-workers, but the poster says we can -- which is right?" Are your managers and HR team prepared to answer these questions or to know how they may respond lawfully to union organizing?
