The risks of doing business have never been higher in the health care industry. Re-energized labor unions have this region’s health care institutions squarely in their sights as one hospital after another has become the target of highly organized and effective corporate campaigns. In addition, the privacy and security regulations promulgated under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) pose unique and often vexing challenges for health care employers, particularly when employees become patients and patient medical records are injected into employment disputes. The stakes in meeting these challenges have been raised as the Department of Health and Human Services has begun to enforce the HIPAA Privacy Rule more aggressively.

On November 14, 2007, please join a team of veteran Littler attorneys, including Anita Polli and Craig Brown at a breakfast briefing where they will tackle these cutting edge issues and respond to your questions. During this program, we will discuss corporate campaigns in the health care industry and other evolving labor strategies, as well as tactics employed by the unions targeting health care, early warning signs of a corporate campaign, and winning strategies to avoid union organizing efforts. In addition, Philip Gordon, the Chair of Littler's Privacy and Data Protection Practice Group will provide insight into the myriad privacy issues facing health care employers, update you on recent developments in this ever-changing area of the law, and provide pragmatic strategies for meeting the compliance demands of the HIPAA Privacy and Security Rules in the employment context. Rob Wolff will be moderating.
