This presentation will focus on fiduciary responsibility, retirement, health, and welfare plans.

Employers are receiving more scrutiny with respect to retirement plans and health plans due to recent IRS and Department of Labor audit activities. The presentation will address significant challenges employers face with respect to the administration of their qualified retirement plans and health plans, including:

  • Internal Revenue Service audits
  • Department of Labor audits
  • Class action litigation regarding plan investments, expenses, and breach of fiduciary duties

Our speaker will demonstrate best practices to help lessen the risk that employers face with respect to retirement, health care and welfare plans.

Other speakers will also cover:

  • Who is a fiduciary?
  • What does the term "fiduciary" mean under ERISA §§3(21) & 3(38) and why does it matter?
  • What steps can you take to limit your fiduciary liability? And if you are found non-compliant, what might your liability be?
  • What about litigation—should I be worried?
