Collective actions under the Fair Labor Standards Act and state wage-hour laws have proliferated within the past few years and continue to be of paramount concern to employers. Suits involve claims of the misclassification of employees as exempt from overtime pay, employees working off the clock, and other alleged violations of federal and state wage-hour laws. They create massive potential liability for companies, attract the attention of regulators, mandate changes in employer’s time keeping and pay practices, inspire bad press, and can undermine employee relations.
