Can employers push back when an employee makes an unreasonable FMLA or ADA request? In the litigious times we live in, many human resources professionals and attorneys have come to believe the answer is always “no.” Employers are so often told what they cannot do, it is easy to lose sight of everything they can do. The speakers will identify actions that employers can take under the ADA and FMLA in a variety of common leave and accommodation situations. Many of these actions are “reverse-engineered” from existing, but little-known, provisions of the regulations and case law.

This presentation will be an informative and practical discussion covering the application of FMLA and ADA, including pushing back on certification problems, the appropriateness of medical exams or testing, addressing potential abuse, dealing with frustrating requests for reasonable accommodation, dealing with performance problems in the face of FMLA and ADA issues and more.
