Since the enactment of the Americans with Disabilities Amendments Act and the regulations related thereto, key issues have arisen under the ADA on which the Equal Employment Opportunity Commission (EEOC) and numerous courts have expressed contrasting positions. Despite an enforcement agenda focused, in part, on reasonable accommodations under the ADA and related litigation efforts, the EEOC has not provided employers with recent formal guidance on the ADA. While that might actually be a beneficial omission for employers, the fact is that the EEOC's informal ADA positions as exemplified in public statements and its position in litigation is in some areas divergent from certain court rulings. This inconsistency should be worrisome to employers.

In this insightful, one hour and fifteen minute session, the presenters will identify divergent perspectives on certain key ADA issues and provide practical insights for employers facing these ADA issues. The discussion will include:

  • Limits on continuous absences policies and the ADA
  • End of Family and Medical Leave Act (FMLA) considerations, including leave in excess of FMLA as an accommodation and replacement versus termination
  • Undue hardship analysis, including indefinite leaves of absence and work from home accommodation requests
  • Attendance as an essential function of one's job
  • Light duty policies limited to workers' compensation
  • Preferential treatment in competing for vacancies as an accommodation
  • Wellness programs
