"An employer should set up a mechanism for a prompt, thorough, and impartial investigation into alleged harassment. . . . The employer should ensure that the individual who conducts the investigation will objectively gather and consider the relevant facts. . . . Whoever conducts the investigation should be well-trained in the skills that are required for interviewing witnesses and evaluating credibility."
- Equal Employment Opportunity Commission, Enforcement Guidance: Vicarious Employer Liability for Unlawful Harassment by Supervisors (June 18, 1999) on using an investigation to avoid or mitigate liability

Every employer in the United States is routinely confronted with the need to investigate workplace incidents, ranging from allegations of discrimination to financial wrongdoings to alleged misconduct, which may become the subject of internal disciplinary proceedings or governmental review.

Making the right decision often turns on the quality of the investigation that has been conducted. Without the facts, decision making is flawed and can expose the employer to significant liability. The task of conducting an effective investigation is not an easy one. Many human resource practitioners remain unsure about the employer's rights and obligations and the best way to proceed.

"Conducting Lawful Investigations" is aimed at teaching the practical skills necessary to investigate workplace incidents. Participants will learn how to prepare for an investigation, how to conduct interviews, and the skills of effective report writing.

This full-day, interactive training program will combine PowerPoint presentations and attendee participation throughout the day in mock investigation scenarios with live actors who will be guided by Littler attorneys: Kathy Cooper Franklin, Jim Zissler, and Pam Salgado.
