In a pending case called Purple Communications, the Board is considering a request by its General Counsel to overrule the 2007 decision known as Register Guard. The Register Guard decision upheld the right of employers to prohibit use of their email systems for "non-job-related solicitations", including union solicitations.

The Board is now considering whether to adopt a rule declaring "that employees who are permitted to use their employer's email for work purposes have the right to use it for Section 7 activity, subject only to the need to maintain production and discipline." The Board's adoption of such a rule would in effect overrule Register Guard.

The NLRB has invited interested parties to file amicus briefs to help the Board reach its final decision on this important issue. The Coalition for a Democratic Workplace (CDW) plans to file an amicus brief on behalf of all of its members, and we anticipate that a number of CDW members will file briefs of their own as well.

To help coordinate this effort, CDW will present this webinar for the benefit of its coalition members, both to inform every one of the important issues at stake, and to highlight the significant points that will be presented to the NLRB in the CDW amicus brief. There will be no charge for the webinar to CDW members.
