The departure of former Chairwoman Wilma Liebman in August, and the Labor Day holiday, provided significant opportunities for the National Labor Relations Board (NLRB) to announce changes in federal labor law that will energize a dispirited labor movement. Among them are a final rule requiring virtually all private sector employers, for the first time, to post notices of employees’ rights under federal labor law; proposed changes to speed up representation elections and to reduce management’s voice in the election process; new rulings making it easier for unions to organize ever-smaller groups of employees and to protect unions from having their representative status challenged; and significantly increased scrutiny of management policies and conduct that allegedly interfere with employees’ concerted activities, both in the workplace and online.
