The NLRB’s new union election rules are currently scheduled to go into effect on April 14. The new rules – referred to by many as “Ambush” election rules – dramatically reduce the time between the filing of a petition with the Board (often the first time an employer becomes aware of union activity) and election day, significantly limit pre-election litigation of potential unit and eligibility issues, and substantially increase the burdens on employers to supply new information within an extremely short time frame. With the typical campaign period significantly reduced, and document burdens increased, unprepared employers will struggle to comply with the burdens imposed while trying to communicate effectively with employees prior to election day. However, there are steps employers can take now both to prepare for responding to a union election petition and to avoid receiving one in the first place.

Our speakers will review the new union election rules and their impact on employers and suggest proactive steps employers can take now to meet the new burdens and prepare for possible ambush organizing at your workplace.
