As Program Director, Erik C. Johnson coordinates with attorneys throughout the firm to manage litigation defended in the Littler CaseSmart® model. Littler CaseSmart utilizes and blends a unique client-dedicated staffing model, redesigned legal processes for greater efficiencies, and case management and data analytics.

Erik uses Littler-developed tools to oversee case workflow, monitor budget to actual metrics, and ensure that the firm’s approach to defending a case aligns with the client’s overall litigation philosophy. He routinely consults with Littler CaseSmart clients to assist them in monitoring litigation metrics and provides other forms of data analytics. Erik also supervises an experienced and diverse team of Littler CaseSmart attorneys.

Before joining the Littler CaseSmart team, Erik's practice included defending employers in claims arising under various federal and state statutes and common law causes of action, with a focus on federal employment discrimination litigation arising under:

  • Title VII of the Civil Rights Act
  • The Age Discrimination in Employment Act (ADEA)
  • The Americans with Disabilities Act (ADA)
  • The Family and Medical Leave Act (FMLA)

Erik has extensive litigation experience in state and federal courts, and he has represented clients before federal and state administrative agencies, including the Equal Employment Opportunity Commission, the National Labor Relations Board, the Department of Labor, and the Occupational Safety and Health Administration. In addition, he has advised employers on the practical and legal implications of everyday employment decisions.

Erik is also a Certified Associate in Project Management and a trained mediator for all types of employment law and contract and noncompete matters.

Erik has given numerous presentations and written articles on a variety of topics, including the following:

  • Alternative dispute resolution
  • The use of mediation for labor and employment disputes
  • The art of negotiations and the proper valuation of cases
  • Effective deposition skills and the discovery process
