The District of Columbia Tipped Wage Worker Fairness Amendment Act (TWWF) enacted in 2018, imposes certain obligations on employers that employ tipped wage earners in the District of Columbia, now taking effect. Among the requirements, DC tipped wage earner employers must:

  • Submit their sexual harassment policy to the DC Office of Human Rights (OHR)
  • Post the sexual harassment policy in a location accessible to employees
  • Distribute the sexual harassment policy to employees
  • Report the number of sexual harassment complaints made to management in 2020, 2021, and 2022 by March 31, 2023

The TWWF also requires that DC businesses with tipped workers undergo sexual harassment training provided by DCOHR-certified trainers, to be completed by August 31, 2023. The training requirements include:

  • Training of nonmanagers in person or online (with a live facilitator) within 90 days of hire for new hires (unless the employee has participated in training in the last two years)
  • Training of nonmanagers, owners and operator in person or online (with a live facilitator) once every two years
  • Training of managers in person once every two years
