Traer Cundiff works with and advises other attorneys on managing risk and best practices in eDiscovery: preservation, collection, review, production, forensic analysis, and remediation. Traer negotiates and drafts ESI protocols, protective orders, 502(d)&(e) orders, as well as forensic analyses of opposing party or client’s devices, such as phones, laptops, etc. Traer also advises and handles matters involving atypical issues in preservation and collection of opposing party data and information, pushing back on the scope and breadth of discovery, and possession, custody and control issues. Traer is heavily involved in motion practice relating to discovery. She has handled and advised on eDiscovery aspects of hundreds of cases from single plaintiff to class and collective actions involving hundreds of plaintiffs. 

Traer has practiced law for nearly two decades, primarily in employment and eDiscovery. She has advised and represented Fortune 500 clients in employment matters such as unemployment, garnishments, discrimination and harassment, employee misclassification, FLSA exceptions, employee breach of contracts, trade secret, restrictive covenants, and records retention. Traer has represented clients in a variety of industries such as tech, energy, medical, hospitality, retail, manufacturing, and commercial. Traer is licensed to practice in federal district courts throughout the country.
