At Littler, we are gearing up for EEO-1 season, when many businesses must inform the federal government about their workforce locations, employee counts, and demographics. In 2020, we prepared for the season but were disappointed as the EEOC postponed collection of 2019 EEO-1 data until the following year. As a result, this year we have double the reporting to anticipate. That's right, employers with at least 100 employees must now file two EEO-1 reports in calendar year 2021.

Although Component 2 compensation data is no longer part of the standard EEO-1 filing, we anticipate this modified schedule, combined with EEOC's retention of a new technology vendor for employer data collection, will bring unexpected challenges. Littler attorneys present an educational hour on the ins and outs of EEO-1 reporting, with topics of particular interest to include:

  • Issues with two-year filing (and organizational structure changes that occurred between the two years)
  • Connecting the dots between EEO-1 filings and federal affirmative action plan audits
  • Complex corporate family issues
  • The ever-burning question of Type 6 versus Type 8 reports
  • Employees of unknown race/ethnicity or sex (including nonbinary employees)
  • Filing mechanics
