In early January, the U.S. Department of Labor's draft of the long-awaited Notice of Proposed Rulemaking (NPRM) on the “white collar" overtime exemptions was sent to the White House Office of Management and Budget (OMB) for review. Issued under the Fair Labor Standards Act, these regulations implement exemptions from the overtime pay requirements for executive, administrative, professional, and certain other employees. If adopted as drafted, the proposed rule would replace the final rule issued in 2016. While the OMB's review of the draft proposed rule could take several months and be further slowed by the partial government shutdown, the time to prepare for change is now.
