This benefits webinar will focus on a topic that is at the center of many actions being brought against retirement plan sponsors and plan fiduciaries – the conduct of those running a plan committee meeting. Plan sponsors and plan fiduciaries are constantly the target of lawsuits alleging that plan fiduciaries are not properly attending to their fiduciary duties. Allegations range from the wrong investments being offered to plan participants; to inappropriate analytics being used in choosing plan service providers; to unnecessary costs, paid by plan participants, relating to third-party services provided to the plan.

The constant in these lawsuits is that plan fiduciaries are alleged to have made bad decisions – decisions which have often been made by a plan committee. We have discovered this is often due to an inappropriate level of attention given to properly conducting a plan committee meeting. Discussion topics include:

  • Which individuals should – or should not – serve on a plan committee
  • Agenda setting process for a fiduciary committee
  • Do's and don’ts of analyzing plan investments
  • Importance of a well-crafted investment policy statement
  • Ways to demonstrate reasonableness of third-party fees
  • How to deal with business issues that arise during the meeting
  • The correct way to record meeting minutes
