Joshua B. Kirkpatrick focuses his practice on employment litigation and counseling. He has represented clients in a wide range of employment and labor law matters in federal and state court in Colorado and Montana, in arbitration and mediation, and before the National Labor Relations Board, the Equal Employment Opportunity Commission and its counterpart state agencies. He has litigated lawsuits arising under:
- The Americans with Disabilities Act
- The Age Discrimination in Employment Act
- Title VII
- The Fair Labor Standards Act
- The Employee Retirement Income Security Act
- Sarbanes-Oxley Act
- State wage and hour statutes and wage orders
- State human rights acts
His practice also places a heavy emphasis on litigation involving trade secrets, non-compete agreements, and unfair competition matters.
Additionally, Joshua has extensive litigation and counseling experience relating to state and federal wage and hour issues, including many claims that have involved attempts by plaintiffs to obtain class or collective action treatment. He also assists employers with drafting executive employment, compensation and separation agreements, and addresses compliance concerns.
Joshua frequently presents before attorneys, human resources professionals and employer organizations on:
- Wage and hour issues
- Workplace discrimination and harassment
- Non-compete and trade secret litigation
- Workplace violence
Additionally, he regularly provides workforce training on various topics, including the prevention of harassment and discrimination (California AB 1825 training), and proper wage and hour practices.
