Littler

Jay C. Counts has extensive experience in handling traditional labor law matters, as well as defending employers against employment discrimination and wrongful termination actions in federal and Texas state courts and before the Equal Employment Opportunity Commission. He handles arbitration and mediation, as well as the litigation of claims arising under:

  • The National Labor Relations Act
  • The Age Discrimination in Employment Act
  • The Americans with Disabilities Act
  • Title VII
  • The Fair Labor Standards Act

He also provides counseling on various employment- and labor-related matters.

Jay regularly represents employers as the chief spokesperson or chief legal advisor in contract negotiations with various labor unions, and, notably, he negotiated the first hospital contract in Texas covering registered nurses. Clients often consult him regarding:

  • Union organizing activities
  • Union avoidance
  • Collective bargaining
  • Contract arbitration
  • National Labor Relations Board proceedings

Jay's clients include sugar and oil refineries, chemical plants, aerospace companies, hospitals, retailers and service organizations.

A frequent speaker before business and professional associations throughout the country, Jay has made numerous presentations on NLRB developments and union activities to various diverse groups, including employer associations and bar groups.

Jay currently is a member of Littler Mendelson's Associates Committee. Previously, he worked at a firm in Washington, D.C., handling various labor and employment matters. Prior to entering private practice, he served as a trial attorney with the NLRB in Fort Worth, Texas, where he was first chair in numerous unfair labor practice trials and served as a hearing officer in numerous representation cases.
