Workplace Diversity and Discrimination Claims

Diversity initiatives and goals are an important part of corporate culture in the United States and abroad. Failure to pay attention to diversity can even amount to evidence of employment discrimination. The OFCCP also has stepped up its enforcement of affirmative action laws among federal contractors through more rigorous audits. On the other hand, actively recruiting under-represented groups can constitute unlawful reverse discrimination if done the wrong way.

We will discuss how to walk the line that lies between effective diversity and inclusion programs and unlawful reverse discrimination. We will also discuss the OFCCP's current enforcement agenda, and how to ensure that attorney-client communications regarding diversity initiatives and affirmative action compliance will remain privileged.
