Immigration enforcement has become a part of the landscape since the failure of comprehensive immigration reform in Congress several years ago. With the Obama administration, however, came a shift in enforcement focus from the illegal immigrants, to the employers who hire them. Most recently, we've seen a substantial increase in Immigration & Customs Enforcement (ICE) audits of employer Form I-9 Employment Eligibility & Verification records, with a record fine for technical violations recently handed down to a high-profile company. Employers large and small must have in place well-drafted I-9 policies and procedures to ensure careful I-9 records management and training of HR, should ICE come calling.
