The Omnibus HIPAA/HITECH Final Rule, published in the Federal Register on January 25, 2013, makes many changes to the HIPAA Privacy Rule, Security Rule, Breach Notification Rule, and Enforcement Rule, with substantial impact on employers who sponsor HIPAA-covered health benefit plans and their service providers, known in HIPAA parlance as business associates. With the revised regulations and related regulatory commentary exceeding 500 pages, identifying critical modifications and discerning how to respond to them will be a major challenge for many employers and business associates. Yet, these changes cannot be ignored as the Department of Health and Human Services (HHS) is increasingly flexing its enforcement muscle to obtain six- and seven-figure settlements and penalties from covered entities and business associates.

This webinar will highlight the practical implications of the Omnibus Final Rule for employers and business associates and help them develop an action plan for compliance. Some of the critical takeaways from this fast-paced, seventy-five minute webinar will include:

  • The new standard for security breach notification and its practical implications
  • New compliance requirements for business associates and how to meet them
  • Negotiating revised business associate agreements
  • Preparing updated privacy notices for the 2013 open enrollment season
  • Modifying existing HIPAA policies in response to regulatory changes
  • Understanding and avoiding HHS' enhanced enforcement authority
  • Knowing the key compliance deadlines
