Sex Offenders, Terrorists and Video Resumes: How Far Can You Go to Get Information on Prospective and Current Employees

Social networking sites, blogs, video resumes, GPS devices, monitoring software, sex offender lists and anti-terrorism lists provide a wealth of information about the person in the next cubicle, not to mention applicants. Can a company/should an employer check an applicant’s Facebook posting before hiring? Can a company terminate an employee who posts a scathing entry on a personal off-duty blog? What should a company do if it finds threatening information posted by an employee on an Internet site? Can an employer restrict a union from using its electronic resources to aid in organizing?
During this session, we will discuss how deeply employers should tap into these new information sources and what the limits of the law are today.
