Purpose:
Hospitals are considering what impact the presidential and congressional shift will have on their organizations over the next four years. Hospitals should anticipate significant changes related to wages, taxes, immigration, civil rights and most importantly, an inevitable increase in unionization in the United States.

The number one item on the labor agenda is the passage of the Employee Free Choice Act (EFCA), legislation designed to dramatically increase unions’ ability to organize workers. Under EFCA, unions will be able to organize employees without the need for a secret ballot election. This would impact business sectors such as hospitals, which are typically free of unionization. Additionally, Congress will consider several other labor-backed initiatives that if passed, would increase the pool of potential unionized employees and lead to increased union organizing.

Similarly, many employment law initiatives to increase available damages in lawsuits by modifying statutes of limitations and removing damage caps are anticipated.  The ADA Amendment Act, effective January 1, 2009, broadens the obligations of employers and the Department of Labor has issued final revised FMLA regulations.

This webinar will examine the major elements of the EFCA and other anticipated labor and employment initiatives, as well as outline the revisions under the ADAAA and FMLA regulations.

At the completion of this webinar, the participants will be able to:
