Preparing for Brinker

Retail employers have been waiting for a decision from the California Supreme Court in Brinker Restaurant Corp., et al v. Superior Court for years. On November 8, 2011, the California Supreme Court heard oral argument in the case and should issue its decision by February 9, 2012.

During oral argument, the Court seemed inclined to adopt an employer-friendly "make available" standard. But it also discussed a rolling 5-hour rule for meal periods, the impact of problematic policies on class certification and the possibility of a decision that would apply only on a going-forward basis only.
