The "New" NLRB is Making Changes: What This Means For Employers

For years, the NLRB has had too few members to decide important cases, and those cases have been "stacking up," awaiting the appointment of new members. During the latest Bush administration, when there were enough members, the cases often were decided favorably to employers. With recent appointments by the Obama administration, the Board now has four members, enough to move forward with the process. Unfortunately, the composition of this "New" Board favors Union interests, and this "New" Board is issuing a number of noteworthy decisions - even considering revisiting older decisions by the Bush-era Board. The results for employers have not been good, and more of the same appears to be on the way.
This program will begin with what the Board has done over the last few months, then move on to discuss what is likely to be the outcome of other significant cases, as well as older decisions that might be revisited. Finally, we'll talk about what steps employers might take now to minimize the effects of these decisions on their organizations in the future.
