The New Employee Rights Posting Requirement: the Latest from the Board

Employers are preparing for the new NLRB rule mandating that private sector employers subject to the National Labor Relations Act post a notice to employees explaining their rights to organize under the law. The twice-extended effective date of April 30, 2012 is fast approaching. One court hearing cases on the validity of the poster has already opined that the Board has the power to require the posting, but exceeded its power in regard to related remedies. Another court ruling is expected soon.

Because the posting must be in a "conspicuous place" readily seen by employees, for the first time, most employees in the U.S. will now be formally notified of their right to unionize. The NLRB's posting requirements are detailed in both form and substance, including size, typeface and electronic posting. Are your managers and HR team prepared to answer questions about strikes, picketing, "concerted" activity, or how the company feels about unionization?

This webinar will address the latest on the technical posting requirements and how to anticipate and respond to employee conduct that results from the posting. In addition, we will touch briefly upon recent developments in labor law, including the status of the new NLRB election rules and challenges to the recess appointments to the Board.
