Employers and health care providers are now confronting new, more challenging federal laws intended to safeguard employee and patient health information. Major amendments to HIPAA (contained in the HITECH Act), which go into effect over the next six months, impose significant security breach notification and other obligations on employers, health care providers, and the vendors (known, in HIPAA parlance, as business associates) who serve them. At the same time, the Genetic Information Non-Discrimination Act of 2009 (GINA), effective November 21, 2009, has established an entirely new ground for employment discrimination based on genetic information and has created a complex set of rules governing the acquisition, use, and disclosure of that information. The implications of these new laws are far reaching and not always obvious.
