The intersection of health information and the workplace has become even more treacherous. Major amendments to HIPAA (contained in the HITECH Act) become effective over the next six months and impose significant new compliance obligations on employers, health care providers, and the vendors (known, in HIPAA parlance, as business associates) who serve them. At the same time, the Genetic Information Non-Discrimination Act of 2009 (GINA), effective November 21, 2009, has created an entirely new ground for employment discrimination based on genetic information and has created a complex set of rules governing the acquisition, use, and disclosure of that information. The implications of these new laws are substantial and not always obvious.
