Managing employees with medical conditions is a complex and often frustrating process for employers. The legal maze created by the laws governing this area will become even more challenging for employers to navigate in January 2009 when amendments to the Americans With Disabilities Act (ADA) and to the Family and Medical Leave Act (FMLA) regulations go into effect. These amendments are significant and will have a dramatic impact on how employers handle employee leaves of absence. Employers who are not prepared for these important changes, and who have not amended their policies and procedures to account for the new rules, will be exposed to greater legal risks.
