Fall Employment Law Mini-Series

With the continuing surge of wage and hour claims, exemption misclassifications have become one of the primary targets of federal and state regulators, and plaintiff's counsel. From our many years of experience handling misclassification claims, Littler has developed a process that can help employers effectively prepare for and deal with such claims. This session will discuss recent developments in misclassification litigation and show how the Littler Xmpt™ process can equip management with an effective defense and create a strong evidentiary record to either defeat an exemption challenge or mitigate the risks.

The session will cover the following:

  • Overview of recent developments in misclassification litigation, including class and collective actions
  • Discussion of the biggest challenges facing employers who are faced with misclassification
  • Proactive steps that employers can take either before or during litigation to help protect the company against misclassification claims
