In President Obama's first term, employers saw rulemaking and NLRB decisions shift the balance in labor relations law strongly in favor of organized labor. Employers can expect the pendulum to swing even further in the direction of organized labor during President Obama's second term. With a Republican-controlled House and closely-divided Senate in the next Congress, the Obama Administration is likely to continue to use rulemaking and administrative actions to reward labor's support in the close 2012 election and to pursue its labor agenda of increasing union organizing and expanding labor's reach.
