The risks of doing business have never been higher in the health care industry. Re-energized labor unions are expanding their well-financed organizing campaigns across the country, and Colorado's health care institutions are squarely in their sights. Hospitals and other health care institutions will become targets of highly organized and effective corporate campaigns. New decisions by the NLRB and the possibility of passage of some form of the Employee Free Choice Act in the next Congress complicate the picture.

At the same time, the privacy and security regulations promulgated under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) pose unique and often vexing challenges for health care employers, particularly when employees become patients and patient medical records are injected into employment disputes. The stakes in meeting these challenges have been raised as the Department of Health and Human Services has begun to enforce the HIPAA Privacy Rule more aggressively.

A team of veteran Littler attorneys who have been fighting these corporate campaigns, including Anita Polli of Littler's Boston office and Larry Marquess of Littler's Denver office will tackle these cutting edge labor issues and respond to your questions.
